A) A legacy is a gift which you leave in your Will to a person or an organisation, such as a charity like European Lung Foundation. This gift can be a specific item, a sum of money, a percentage (or even all) of what is left in your estate, after any other arrangements have been given out and any debts and expenses have been paid.
A) When you are making or amending your Will, your solicitor will advise you on the specific clauses that should be inserted so that your wishes are carried out. If you would like to leave a gift to European Lung Foundation, you will need to provide our charity details: European Lung Foundation, 442 Glossop Road, Sheffield, S10 2PX, UK.
A) There is no legal requirement to have a solicitor draft your Will. However, it is best to seek advice as drafting a Will is not always straightforward. A solicitor will ensure that your Will reflects your wishes and ensures that it is legally valid.
A) Normally, a charity would not be informed about a legacy left in a Will until the donors’ passing or if you inform us at info@europeanlung.org or use our Pledge Form.
A) Tax benefits vary in different countries. European Lung Foundation suggest you seek advise from a solicitor or look on your government website for details regarding this.
A) If you would like to update your Will, you could make a new Will. However, if you simply wish to add in a legacy of an item or of cash, a formal change to your Will should be enough. Whether you make a new Will entirely or just make an amendment depends on how much you would like to change your existing Will. You should speak to a legal advisor to decide which is best for you.
A) European Lung Foundation is very grateful for any donation it receives. No matter how large or small, any contribution helps to support our mission. We rely on the generosity of the public and its supporters; so, any gift can make a real difference.
A) There are a few types of legacies available. You could leave either gift a fixed sum of money, a specific item or investment in your Will. Alternatively, you could gift the remainder or a proportion of the remainder of your estate, after all expenses, tax and other agreements have been paid. European Lung Foundation welcomes all donations because any contribution helps support our mission. If you are unsure what you will own when you pass away and do not want to write a specific figure or item into your Will, you could leave a proportion or a percentage of your estate to European Lung Foundation.
A) If your circumstances change or you decide you no longer wish to leave a legacy in your Will you can make an amendment to your Will, or by cancelling the Will in its entirety at any point.
A) Yes. You can either leave your legacy as a gift subject to an expression of wish or a gift subject to binding obligations as to its use. However, this can cause significant problems, especially if that activity is no longer being carried out, so an unrestricted gift is preferable. European Lung Foundation always recommends seeking legal advice and takes no legal responsibility for anything related to your Will. Please contact a solicitor for further legal matters regarding your Will.
